By applying and participating in the Hack4Growth, all participants have consent to the Hack4Growth Code of Conduct as well as the Terms and Conditions as follows:

Code of Conduct

We want everyone to have a great experience at Hack4Growth. To ensure a safe environment, all attendees (which includes but is not limited to participants both in-person and remotely, sponsors, partners, coaches, mentors, judges, volunteers, and staff) are required to abide by this Code of Conduct.

  1. We do not tolerate harassment of attendees, in any form and under any circumstances. Harassment includes, but is not limited to, offensive verbal comments related to gender, gender identity and expression, age, sexual orientation, disability, physical appearance, body size, race, ethnicity, nationality, or religion, sexual images in public spaces, deliberate intimidation, stalking, following, photography or audio/ video recording against reasonable consent, disruption of talks or other events, inappropriate physical contact and unwelcome attention.
  2. Attendees requested to cease any harassing behavior are expected to comply immediately. If you are being harassed, observe or learn of someone else being harassed, or have any other concerns, please notify a member of the corporate team immediately.
  3. If an attendee engages in harassing behavior or conduct deemed in any way inappropriate, the organizers may take any countermeasure they deem appropriate. This includes warning the offender, expulsion from Hack4Growth and/or reporting their behavior to law enforcement agencies.

Competition Rules and Regulations

1. Eligibility

  • Participants must be at least 15 years old and have parents or guardians’ approval for participating in the contest; each team must have at least one member who is aged 18+ and has Vietnamese nationality/origin.
  • All team members must not be prosecuted for criminal liability at the time of participating.
  • All team members must participate in every competition round as specified by the Organizers in item 5.
  • The participant is allowed to join 1 group only.

2. Registration Methods

  • Participants can register as a group of 3-5 members.
  • Should participants have not been on any team yet or have an insufficient number of members, they can find and group with other contestants using the V-Space platform supported by the Organizers.

5. Rules for Submissions

  • Submissions must be an application form.
  • Submissions must be presented and submitted in either Vietnamese or English language, on the V-Space;
  • In the competition, participants will develop, present, or improve a project idea, prototype, product, or demo to perform and submit to the judges (“Submission”). Prototypes or demos can be done in print forms, applications, storyboards, logic diagrams. The submissions that pass the preliminary round will be selected for the final round;
  • The Submission must be the participant’s original work and must not be funded or commissioned, in whole or in part, by any third party;
  • The submission must not contain material that constitutes copyright infringement or violates or infringes another’s rights, including but not limited to privacy, publicity, or intellectual property rights. Participants shall immediately notify the Organizers if there is any infringement detected. Participants are solely responsible for any third-party claims related to the competition, and agree to indemnify, protect, and keep the Organizers from any damages and costs incurred from and under any claims; 
  • The Submission may use publicly available APIs and data;
  • Participants warrant that their submissions:
    • Do not contain material that is unlawful, in violation of, or contrary to applicable laws or regulations of Vietnam;
    • Do not contain gratuitous violence, gun or other imagery or gestures of weapon;
    • Do not contain nudity, explicit, graphic, or sexual activity;
    • Do not contain material that is inappropriate, indecent, obscene, hateful, tortuous, defamatory, slanderous, or libelous; 
    • Do not contain prohibited substances according to Vietnam’s law;
    • Do not contain material that promotes bigotry, racism, hatred, or harm against any group or individual or that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
    • Do not contain commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, or logos;
    • Do not contain personal information such as license plates, phone numbers, personal addresses – physical or email or otherwise.

6. Competition Timeline

  • Round 1: Registration (July 1st – October 31st, 2022)
    • The deadline for completing the registration of all team and project information on the website is 23:59 (GMT + 7) on October 31, 2022;
    • After the first round, the judges will select the Top 20 best globally to enter the next round. The top 20 will be required to submit a business plan. Then select the Top 10.
  • Round 2: Training & Mentoring (November 15th – December 15th, 2022)
    • Participating teams and mentors will find and match with each other via the V-Space platform. The Organizers will provide a list of mentors on V-Space. Should there be any difficulties during the matching process, the participating teams can contact the Organizers for support;
    •  Online training series: Participating teams are trained and mentored by their mentors and/or advisors to implement their ideas;
    • At the end of the second round, the Top 10 best teams will enter the final round.
  • Round 3: Finale (December 15th – December 31st, 2022). To be announced
    • The selected teams will submit their business plan to the Organizers, present, and join the pitching event with their project.

Rights, Obligations, and Responsibilities of Participants

  1. Participants have the right to participate in events, training, and other activities of Hack4Growth.
  2. Only selected participants are allowed to participate in all related proceedings, events, and training; unauthorized individuals and/or non-participants are not admitted in any related proceeding, event, or training.
  3. By submitting the Submission, the Participant confirms that they are not aware of any intellectual property rights in or associated with the Submission that is owned by third parties or may prevent commercial exploitation of the Submission.
  4. Ownership of intellectual property (IP) rights in the Submission will remain with the Participant. You are free to use your Submission (and any creative ideas, concepts, materials and works it embodies) in any way you wish after the Event. 

Authorities and Responsibilities of the Organizer

  1. The Organizer is allowed to use participants’ works and photos/videos of you for non-commercial and/or promotional purposes, such as campaigns for future hackathons.
  2. The Organizer wishes to have the right of first refusal to opt to work with Participants to further develop their Submissions. For six (6) months following the Hackathon, the Organizer requests that the Participant contacts the Organizer in written format before communicating with anyone else about using, further developing, or commercially exploiting the Submission and any creative ideas, concepts, materials, and works it embodies. The Organizer will confirm its decision promptly.
  3. The Organizer reserves the right to cancel or postpone the Event for any reason without liability.
  4. The Organizer has the sole discretion to make a decision in the event of unforeseen circumstances.
  5. The organizers can amend and supplement the contest terms as needed for the actual situation without prior notice and without the consent of the contestants.
  6. The Organizer reserves the right to cancel the contest rights of accounts found to be cheating or violating the above terms without notice.

Use of Information and Publicity

  1. Contestants, Organizers, and judges are obliged to ensure confidentiality during the competition. The Organizer has the right to use some information for the promoting and advertising purpose but must not affect the result of the competition.
  2. In this clause “Confidential Information” means secret or confidential commercial, financial, marketing, technical or other information, know-how, trade secrets, and other information in any form or medium whether disclosed orally or in writing, together with any reproductions of such information in any form or medium of any part(s) of this information.
  3. The Participant acknowledges that they may receive or have access to Confidential Information of the organizer, their affiliates, agents and/or suppliers, sponsors, partners in connection with the Event. All Confidential Information shall be kept strictly confidential by the Participant, regardless of whether such information is marked as “confidential”. The Participant agrees that they shall use at least the same degree of diligence to protect the Confidential Information as they use to protect their own confidential and sensitive information (being no less than a reasonable level of diligence). The Participant will not disclose any Confidential Information to anyone. The Participant agrees that they will not use the Confidential Information for any purpose other than participating in the Event.
  4. The above obligations of confidentiality shall not apply to Confidential Information to the extent that: 
  1. The Participant agrees to reasonably use or quote the hashtag, branding, Facebook, or other social media addresses of the Organizer, its affiliates, and the Event without inducing any malicious, unjust or misleading intent.
  2. The Participant hereby grants to the Organizer, their affiliates, and agents acting on behalf of the Organizer a royalty-free, non-exclusive, irrevocable, worldwide right to refer to the Participant and/or the Submission and to use images and/or video/audio footage taken at the Event and/or showing the Submission in any publicity materials and for promotional purposes at any time (including but not limited to the Organizer websites or other media).
  3.  Any and all personal information obtained by the Organizer will be treated in accordance with the Organizer’s data policy. Participants will be contacted in connection with the Event, and unless otherwise indicated may also be contacted by the Organizer about other relevant activities and opportunities.

Disclaimer

  1. The Organizer is not responsible or liable for any alleged violations arising from or related to the competition.
  2. The Organizer is not responsible or liable for all or any loss or damage associated with entering the competition or using the competition’s prizes.
  3. The Organizer does not accept any responsibility for any loss, loss, injury, or disappointment of a participant when participating in the competition or when accepting any of the competition’s prizes.

Provisions on protecting personal data

The General Data Protection Regulation (GDPR) of the European Union sets new global standards for privacy, information security, and compliance.

The Organizer commits to:

  1. Comply with GDPR, as well as provide materials and information to support clients with GDPR compliance.
  2. Have zero tolerance on the issue of transparency and responsible use of information.
  3. Always take maximum care to protect your personal data.
  4. Only use such personal data for legitimate reasons.
  5. Only use sub-processors with the approval of the supervising committee and remain legally responsible as with the sub-processors.
  6. Only handle personal data as directed by the supervising committee, including data transfer.
  7. Ensure that personnel in charge of personal data are committed to confidentiality.
  8. Implement appropriate technical and organizational measures to ensure that the level of privacy of personal data corresponds to the risk level.
  9. Assist supervisors in fulfilling their obligations to respond to data subject’s requests to exercise their rights under GDPR
  10. Implement the request for notification and correction measures as with any failure of complying with GDPR
  11. Assist supervising committee in assessing the impact of data protection and consult with supervisory authorities
  12. Delete or return personal data at the end of the service period
  13. Assist the supervising committee by providing evidence of compliance with GDPR

The transmission of information via the internet is not absolutely secure. While we will do our best to protect your personal data, we cannot guarantee the security of any personal data that you disclose online. You will accept the security implications of using the internet and we will not be responsible for any breach of security unless we violate applicable laws, and only abide by the limits set out in any relevant terms and conditions.

We will retain personal data collected from you if we have a legitimate need to do so.

You have the following rights regarding your personal data:

  1. You have the right to access, correct, update or request the deletion of your personal data. In addition, you may object to the processing of personal data, ask us to restrict the processing of personal data, or request the flexibility of your personal data. You may contact us to exercise these rights.
  2. Similarly, if we have collected and processed your personal information with your permission, you may withdraw your permission at any time. Your withdrawal of permission will not affect the legality of any data processing activities we have conducted before you withdraw your decision, nor will it affect the data processing conducted based on legal grounds applicable beyond your permission.
  3. Although we urge you to make any complaint to us first, you still have the right to complain to the data protection agency about our collection and use of your personal data. For more information, please contact your local data protection authority.

We will respond to all requests received from individuals wishing to exercise their right to data protection in accordance with applicable data protection laws.

General Conditions 

  1. The Participant is solely responsible for all costs and expenses incurred by them in relation to the Submission in the Pre-selection and the Hackathon.
  2. The Participant is solely responsible for any damage to their own property, or any property, facilities, and equipment provided by the Organizer and its partners during the course of the competition.
  3. Without prejudice to any other right or remedy of the Organizer, the Participant may be excluded from the Event or from receiving any prizes or have an awarded prize canceled if the Participant fails to comply with these terms and conditions.
  4. Nothing in these terms and conditions nor the award of any prize shall constitute any obligation on the part of the Organizer or the Participant to enter into any future agreement or relationship.
  5. These terms and conditions relating to the whole agreement and understanding between the Organizer and the Participant relating to the competition.
  6. The Participant may not assign, sub-contract, or otherwise transfer their rights or obligations under these terms and conditions.
  7. The formation, existence, construction, performance, validity, and all aspects of these terms and conditions and any dispute or claim arising out of or in connection with them and/or the Event shall be governed by the Law of the Socialist Republic of Vietnam and the parties submit to the exclusive jurisdiction of the courts of the Socialist Republic of Vietnam.

Commitment of the Participants

By applying and participating in the Hack4Growth, the Participant acknowledges that he/she has read, understood, and agreed in full to these terms and conditions. Following the Participant’s partaking in Hack4Growth, these terms and conditions will become a binding legal agreement between the Organizer and the Participant.
